Cost-effective Conflict Resolution

Sometimes, business partners cannot agree on what is best for their business. When they are unable to resolve their issue, the result can be stresses and strains not only on the partners, but on the business as well. These stresses and strains can damage – and sometimes kill – a business.

The partners might decide that it is best for one partner to buy the other out; but who should buy out whom?  And at what price?

These questions may require partners to bring their case to court but litigation is a time consuming, expensive and public way to resolve disputes. What seems like it should be a small matter for the courts, often drags on for many years and costs hundreds of thousands of dollars. Worse still, the business might be irreparably damaged in the process. The emotional toll on the owners is high and in the end, the judge’s decision may not please either partner. 

Our consultants can assist in resolving these issues and keep partner conflicts out of a courtroom. We act as a neutral party, hired by both sides to help resolve differences in a fair, cost effective way. We gather information from all parties involved in order to prepare our analysis of business value. We then meet with the parties involved to reach agreement on the information and assumptions to be used to value the business. Once we reach an understanding, we calculate value using the data all parties have agreed on. The result is an accurate, honest, business valuation both parties can feel comfortable with.

Some examples of our service includes:

  • Analysis of the value of the business interest in dispute;
  • Suggest structure of payout based upon the company’s cash flow and ability to finance;
  • Determination of appropriate discounts (if any) related to a particular business interest; and,
  • Determination of market compensation for owner-employees.
